Being a
victim of medical malpractice can devastate the
individual as well as their family and friends.
Victims are often torn when facing medical
malpractice issues, and we at Phillip H. Taylor,
M.D., J.D., understand the devastating effects this
can have on you or a loved one.
In our increasingly scientific and technologically
advanced society, we often times take for granted
the access we have to medical care. While
significant advancements in medicine have been made,
physicians, like all individuals, make mistakes.
Such mistakes may amount to medical malpractice.
A medical malpractice claim may be against a
physician, a hospital, or governmental agencies
operating as health care facilities, or a
combination thereof. Medical malpractice occurs when
a negligent act or omission by a medical
professional results in an injury or death of
a patient.
Claims often arise in the following situations:
-
Birth-related injuries (i.e. cerebral palsy)
-
Failure
to diagnose or diagnose in a timely manner
-
Misdiagnosis
-
Surgical
errors resulting in injury or death
-
Patient
neglect or abandonment
Our firm’s
objective is to help individuals and families that
have experienced loss and devastation as a result of
medical malpractice and negligence find justice,
compassion and closure. Let my extensive medical
background and legal experience determine if you
have a legitimate case. Contact our law firm

Wrongful Death
When a person is killed due to another’s
negligence or wrongful conduct, the surviving family
members may have grounds for a wrongful death
lawsuit. Wrongful death lawsuits allow families of
the victim to recover for various damages both the
victim and family have suffered.
The concept of a life lost as a result of medical
malpractice or any other wrongful act forms the
basis of damage recovery for the victim’s family.
Generally, family members who are entitled to bring
a wrongful death lawsuit include a surviving spouse
and/or surviving children. Our law firm understands
the legal complexities and the emotional and
financial strain for family members that are
involved in pursuing a wrongful death claim. Our
continued success and expertise allows us to handle
these challenges with hands on experience and
compassion.
Birth-Related Injury
The birth of a baby is a joyous occasion in the
life of a husband and wife. Too often, the happy
time turns into tragedy if mistakes are made, or if
there is carelessness before, during, or immediately
following the birth. These episodes of carelessness
can have serious and permanent consequences
including, but not limited to cerebral palsy*.
Childbirth is a complicated procedure, and there are
hundreds of potential mistakes and errors that can
cause severe, permanent injury. Eighty percent of
all childbirths end up in some form of complication.
Some of the common complications that occur during
birth include excessive bleeding, prolonged labor,
fetal distress, dysfunctional labor, breech/malpresentation,
and seizures. For example, studies show:
-
For
every 1,000 births, 58 babies suffered from
Meconium Aspiration-(inhalation of undigested
debris), resulting in respiratory distress
-
For
every 1,000 births, 42 babies suffered fetal
distress-(lack of oxygen to the infant), also
known as ***hypoxia
-
For
every 1,000 births, 38 babies were delivered in
a breech/malpresentation position, resulting in
severe or permanent injury
Even more tragically, many newborn children have
died due to medical carelessness.
Birth injury cases are among the most complex
and demanding type of lawsuits and often have
very large settlements, therefore requiring the
most experienced and
proven Trial Lawyers. However, the multimillion
dollar verdicts are often necessary to care for
a lifetime of responsibilities stemming from the
carelessness at birth.
For more than 16 years, I have represented the
children and families of those harmed at the
hand of negligence. I have successfully brought
justice to those deserved, and will continue the
fight to prevent further negligence of another
baby.
